These Terms and Conditions set out the basis on which Rubbish Removal Merton provides rubbish removal and waste collection services in the United Kingdom. By making a booking, using our services, or allowing our operatives to access your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before placing any order.

1. Definitions

In these Terms and Conditions, the following words have the meanings given below:

Customer means the person, business, or organisation requesting rubbish removal or associated services from Rubbish Removal Merton.

Services means any rubbish removal, waste collection, clearance, loading, transportation, or related services provided by us.

Waste means any rubbish, household waste, commercial waste, garden waste, bulky items, or other materials that the Customer asks us to remove, subject to applicable laws and restrictions.

Contract means the agreement between the Customer and Rubbish Removal Merton for the supply of Services, incorporating these Terms and Conditions and any written confirmation of the booking.

We, us, our means Rubbish Removal Merton, the service provider.

2. Scope of Services

Rubbish Removal Merton provides rubbish removal, waste collection, and clearance services for domestic and commercial customers. Our services may include collection of bagged waste, removal of bulky items, clearing of specified areas, loading of materials into our vehicle, and responsible disposal at authorised facilities.

We will only remove waste and items that have been clearly identified and agreed at the time of booking or as subsequently agreed with our operatives on site. We reserve the right to refuse removal of any waste that is hazardous, prohibited, illegal, excessively heavy, unsafe to handle, or otherwise unsuitable for collection under applicable regulations or health and safety requirements.

3. Booking Process

3.1 Customers may book Services by telephone, email, or through any booking system we make available. All bookings are subject to availability and acceptance by us.

3.2 When making a booking, the Customer must provide accurate and complete information, including but not limited to the address for collection, access details, type and approximate volume or weight of waste, any items requiring special handling, and any relevant parking or entry restrictions.

3.3 Based on the information supplied, we may provide an estimated price or price range. This estimate is given in good faith but is not binding if the actual volume, weight, nature of the waste, or access conditions differ from those described at the time of booking.

3.4 The Contract comes into effect when we confirm the booking verbally, by email, or through a booking confirmation notification, and the Customer accepts the proposed date, time window, and pricing basis.

4. Access and Parking

4.1 The Customer is responsible for ensuring that our vehicle and operatives have safe and reasonable access to the collection address at the agreed time. This includes arranging suitable parking, providing correct entry codes or keys, and informing us of any height, weight, or access restrictions.

4.2 Any parking charges, permits, or penalties incurred due to insufficient or incorrect information provided by the Customer may be added to the final invoice and shall be payable by the Customer.

4.3 If we are unable to access the premises or the waste due to circumstances within the Customer’s control, we may treat the booking as cancelled by the Customer and apply the relevant cancellation charges outlined in these Terms and Conditions.

5. Pricing and Quotations

5.1 Unless otherwise stated, our prices are based on some or all of the following factors: volume of waste, weight, type of material, labour required, time spent on site, access conditions, and disposal costs.

5.2 Any quote or estimate given before collection is based on the information provided by the Customer and is subject to change if the actual waste or conditions differ on arrival. Our operatives will assess the waste on site and confirm the final price before loading. If the Customer does not agree to the revised price, we will not proceed, and a call-out or cancellation fee may apply.

5.3 All prices will be stated in pounds sterling and will include any applicable taxes or charges, unless we clearly state otherwise.

6. Payments

6.1 Payment is due in full upon completion of the Services, unless alternative payment terms have been agreed in writing in advance.

6.2 We accept payment by cash, debit card, credit card, or other methods that we may offer from time to time. Business customers may, at our discretion, be granted account terms subject to credit checks and agreed payment conditions.

6.3 Where account terms have been agreed, invoices are payable within the timeframe specified on the invoice. If no timeframe is specified, payment is due within 14 days of the invoice date.

6.4 If payment is not received when due, we reserve the right to charge interest on the overdue balance at the statutory rate, to recover any reasonable costs of collection, and to suspend or cancel any further Services.

7. Cancellations and Amendments

7.1 The Customer may cancel or amend a booking by contacting us as soon as possible. Any cancellation or amendment must be confirmed by us.

7.2 If the Customer cancels the booking more than 24 hours before the scheduled arrival time, no cancellation fee will normally apply. If the Customer cancels within 24 hours of the scheduled arrival time, we may charge a cancellation fee to cover our reasonable costs.

7.3 If our operatives attend the site at the agreed time and are unable to carry out the Services due to the Customer’s failure to provide access, the waste not being available, or other reasons within the Customer’s control, we may charge a full or partial fee for the missed visit.

7.4 We reserve the right to cancel or reschedule a booking at any time due to operational issues, vehicle breakdown, adverse weather, staff illness, safety concerns, or other circumstances beyond our reasonable control. In such cases, we will notify the Customer as soon as reasonably possible and offer an alternative appointment time. We will not be liable for any indirect loss or expense arising from such cancellation or rescheduling.

8. Customer Obligations

8.1 The Customer must ensure that the waste intended for collection is properly described, reasonably accessible, and does not contain any prohibited, hazardous, or restricted materials unless previously declared and accepted by us.

8.2 The Customer must separate waste where necessary and comply with any instructions given by our operatives regarding safe handling, loading arrangements, or local waste rules.

8.3 The Customer warrants that they either own the waste or have the authority of the owner to request its removal, and that no other party’s rights are infringed by the removal or disposal of the waste.

8.4 The Customer must not request the removal of any waste that is illegal to possess, transport, or dispose of. If we reasonably suspect that waste is unlawful or dangerous, we may refuse collection and report the matter to the relevant authorities if appropriate.

9. Excluded and Hazardous Waste

9.1 Certain types of waste cannot be collected under our standard Services, including but not limited to asbestos, certain chemicals, solvents, oils, pressurised containers, clinical or medical waste, radioactive materials, and other hazardous substances as defined by UK law.

9.2 Where specialised handling or disposal is legally required, we may offer a separate service or refer the Customer to an appropriate specialist provider. Any such arrangements will be subject to separate terms and pricing.

9.3 If excluded or hazardous materials are discovered amongst the waste after loading, we may make additional charges to cover safe handling, segregation, and lawful disposal, or we may return such items to the Customer where permitted by law.

10. Performance of Services

10.1 We will carry out the Services with reasonable care and skill, in a professional manner and in accordance with applicable laws and industry standards.

10.2 Any time or date given for attendance is an estimate and not a guaranteed appointment. We will make reasonable efforts to attend during the agreed time window but cannot be held liable for delays caused by traffic, accidents, weather, or other circumstances beyond our reasonable control.

10.3 Our operatives will not dismantle or remove structural parts of buildings, nor will they undertake electrical, plumbing, or other specialised works unless expressly agreed. Any such work would be subject to separate terms and pricing.

11. Limitation of Liability

11.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter where liability cannot be excluded or limited by law.

11.2 Subject to the above, we shall not be liable for any indirect, consequential, or special loss or damage, including but not limited to loss of profits, loss of business, loss of opportunity, or loss of goodwill arising in connection with the Services or these Terms and Conditions.

11.3 Our total liability for any claim arising out of or relating to the Contract or the Services shall not exceed the total amount paid or payable by the Customer for the specific service giving rise to the claim.

11.4 The Customer must notify us in writing of any damage, loss, or complaint relating to the performance of the Services as soon as reasonably possible, and in any event within 7 days of the date of service. We may, at our discretion, investigate the matter, request evidence, and propose a reasonable remedy where appropriate.

12. Waste Transfer and Documentation

12.1 We operate in accordance with relevant UK waste legislation and regulations. Where legally required, we will issue a waste transfer note or similar documentation to confirm collection and transfer of controlled waste.

12.2 By using our Services, the Customer acknowledges and agrees that we may store records of collections and transfers for the periods required by law and may provide such information to regulators or enforcement authorities if properly requested.

13. Compliance with Waste Regulations

13.1 We will only dispose of waste at authorised, licensed, or permitted facilities, in accordance with applicable UK waste management and environmental regulations.

13.2 The Customer agrees to provide accurate information about the nature and origin of the waste to enable us to comply with regulatory requirements.

13.3 If the Customer provides false or misleading information that results in a breach of waste regulations, the Customer shall be responsible for any resulting liabilities, costs, or penalties incurred by us.

14. Data Protection and Privacy

14.1 We will handle any personal data provided by the Customer in accordance with applicable data protection law in the United Kingdom.

14.2 Personal information may be used for the purposes of administering bookings, providing Services, processing payments, handling queries or complaints, and complying with legal obligations.

15. Force Majeure

15.1 We shall not be in breach of these Terms and Conditions nor liable for any delay or failure to perform our obligations where such delay or failure results from events, circumstances, or causes beyond our reasonable control, including but not limited to extreme weather, strikes, accidents, disease outbreaks, transport disruptions, or changes in legislation.

16. Variation of Terms

16.1 We may update or amend these Terms and Conditions from time to time. Any changes will apply to new bookings made after the date the updated terms are published or notified.

16.2 The version of the Terms and Conditions in force at the time of the booking will govern that particular Contract, unless the parties expressly agree otherwise in writing.

17. Severability

17.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.

18. Governing Law and Jurisdiction

18.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.

18.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided.

19. Entire Agreement

19.1 These Terms and Conditions, together with any written booking confirmation or invoice issued by us, constitute the entire agreement between the Customer and Rubbish Removal Merton in relation to the Services. They supersede any prior discussions, correspondence, or understandings.

19.2 No variation of the Contract shall be binding unless agreed in writing by an authorised representative of Rubbish Removal Merton.
